This Refund and Cancellation Policy sets out the basis on which refund and cancellation requests are addressed by Naresh J. Dulani, Sole Proprietor (the "Practice"). It applies to all purchases of the Services made through the website at nareshdulani.com or through the Practice's authorised payment channels.
By completing payment, the Client is taken to have read, understood, and accepted this Policy in its entirety. Defined terms used in this Policy bear the meanings given in clause 1.
01Interpretation
1.1 This Refund and Cancellation Policy (the "Policy") sets out the manner in which refund and cancellation requests are addressed by Naresh J. Dulani, a sole proprietor practising under the trade name "Dr. Naresh J. Dulani – Global Scientific Vastu Advisory" (the "Practice", "we", "us", or "our"). Defined terms not otherwise defined herein bear the meanings given in the Terms of Service.
1.2 This Policy applies to all purchases of the Services made through the Site, through the Practice's Razorpay-hosted payment page, or through any other authorised payment channel.
1.3 This Policy forms part of, and is incorporated by reference into, the Terms of Service. The Privacy Policy continues to govern the Processing of Personal Data submitted in connection with a refund request.
02Nature of the Services
2.1 The Services consist of bespoke advisory engagements that are research-led, time-bound, and personalised to the Client. Owing to the customised character of the Services and the irrecoverable allocation of professional time on receipt of an Engagement, refunds are governed by the principles set out in this Policy.
03All Purchases Final
3.1 Save for the limited exceptions set out in clause 5 and clause 6, all purchases made through the Site or the Practice's authorised payment channels are final. No refund, exchange, or return shall be issued in respect of any Engagement once an order has been confirmed and payment has been received in cleared funds.
04Cancellations
4.1 Order cancellations are not permitted once payment has been processed. The Client is requested to verify the scope, the deliverables, and the Fees in writing before completing payment.
4.2 Rescheduling of a confirmed appointment may be requested by writing to payments@nareshdulani.com. Rescheduling is granted at the sole discretion of the Practice, subject to availability, and does not constitute a refund right or any other entitlement.
05Exceptions
5.1 Notwithstanding clause 3, the Practice may consider a refund request in the following limited circumstances.
5.1.1 Fraudulent transactions. Where the Client establishes, with supporting documentary evidence (including, where applicable, a formal police complaint or first information report), that the transaction was effected fraudulently and without the Client's authorisation.
5.1.2 Billing or payment-processing errors. Where a billing or payment-processing error has been confirmed by the Practice or the relevant payment processor, including duplicate charges, incorrect amounts, or charges to the wrong account.
5.2 Any refund issued under this clause 5 shall be at the Practice's sole discretion following investigation, and shall be limited to the amount established to have been collected in error.
06Cancellation by the Practice
6.1 Where the Practice is unable to deliver a confirmed Engagement for reasons attributable solely to the Practice, the Client may elect, at the Client's sole option, between (a) rescheduling the Engagement at no additional charge, or (b) receiving a refund of the Fees paid in respect of the affected Engagement.
6.2 Clause 6.1 does not entitle the Client to any refund or remedy in any circumstance other than as expressly set out in this Policy.
07Force Majeure
7.1 Neither party shall be in breach of these Terms or this Policy by reason of any failure or delay in performance caused by circumstances beyond reasonable control, including natural disasters, epidemic or pandemic, governmental action, war, civil disturbance, strike, internet or telecommunication failures, or failure of third-party services. Where a force-majeure event prevents delivery of an Engagement and rescheduling is not practicable within a reasonable period, the parties shall discuss in good faith an appropriate resolution, which may include a credit toward a future Engagement.
08Refund Processing Timelines
8.1 Where a refund is approved under clauses 5 or 6, the Practice shall initiate the refund within five (5) to seven (7) business days of approval, to the original payment instrument used for the transaction.
8.2 Issuing-bank and card-network settlement times may add a further three (3) to ten (10) days, depending on the jurisdiction of the Client and the payment instrument used. The Practice shall not be liable for delays attributable to the issuing bank, the card network, the unified-payments- interface infrastructure, or any other intermediary outside the Practice's reasonable control.
09Currency, Taxes, and International Payments
9.1 All Fees are quoted and payable in Indian Rupees (INR) unless otherwise expressly agreed. Goods and Services Tax (GST) at the prevailing rate is added at checkout in accordance with the Central Goods and Services Tax Act, 2017.
9.2 For international payments, currency conversion is performed by the payment processor and the Client's issuing bank at their prevailing rates. Any refund approved under this Policy is processed in INR and reconverted by the Client's bank at the time of credit. The Practice accepts no responsibility for currency-conversion differences, foreign-transaction fees levied by the issuing bank, or third-party intermediary charges.
10Disputes and Chargebacks
10.1 The Client is requested to direct any concern about a charge to payments@nareshdulani.com in the first instance, before initiating a chargeback with the issuing bank or card network.
10.2 The initiation of a chargeback in respect of a delivered Engagement, or the initiation of a chargeback without first seeking resolution from the Practice, may be treated by the Practice as a material breach of the Terms of Service. The Practice reserves the right to contest any chargeback with full supporting documentation and to suspend further dealings with the Client pending resolution.
11Statutory Rights
11.1 Where the Client is a "consumer" within the meaning of the Consumer Protection Act, 2019 of India, or any analogous consumer-protection regime applicable to the Client, the Client's mandatory statutory rights are not affected by this Policy. Where a provision of this Policy is inconsistent with such a mandatory statutory right in respect of a particular Client, that provision shall, in respect of that Client and to the extent of the inconsistency, be read down so as to give effect to the statutory right.
12Amendments
12.1 The Practice may amend this Policy from time to time. Where an amendment is material, the Practice shall update the "Last reviewed" date displayed on the Site and, where appropriate, notify Clients by email or a prominent notice on the Site. Continued use of the Site or completion of any purchase after the effective date of the amendment shall constitute acceptance of the amended Policy.
